Chapter 1 General Provisions

Purpose

The purpose of these Terms of Service is to prescribe the rights, obligations, and responsibilities of the Company and its members and other necessary matters concerning the use of the Moodoo Service provided by BlueSignum Corp. (the “Company”).

Definition

• The terms used in these Terms of Service have the meaning set forth below:
  1. “Member” means an individual who creates an account through subscribing to the Services and uses the Services.
  2. “Non-Member" means an individual who uses portion of the Services without subscribing to the Services and creating an account.
  3. “User(s)” refers to Members and Non-Members collectively.
  4. “Mobile Device” means a device that can download or install Content for use, including mobile phones, smartphones, personal digital assistants (PDA), tablets, and similar devices.
  5. “Content(s)" means all contents that the Company produces digitally and provides for free or for a fee which can be used on a mobile device as part of the Services, including any symbols, texts, voices, sounds, pictures, videos, figures, colors, and images (including any combinations of such content).
  6. "Store" means an environment set up to install and make payments for applications on a mobile device.
  7. "Application" means any program that is downloaded or installed via a mobile device for the purpose of using the Service.
  8. "Service(s)" means all services related to the Moodoo application, which is a mobile application provided by the Company that allows the Users to record their feelings and provides recommendation of activities based on the recorded emotions.
• Except as otherwise provided in paragraph 1, the terms used in these Terms of Service shall have the meanings set forth in the applicable laws and each Service policies, and those not provided therein shall be subject to general commercial practices.

Provision of Company Information

The Company shall display the following information either within the Service or on the Company's website so that Members can easily access the information. However, the Users may access the Company’s Privacy Policy and Terms of Service on a separate linked screen.

2. Company address
3. Fax number and email address
4. Business registration number
5. Telecommunication business report number
6. Privacy Policy
7. Terms of Service

Effect and Change of Terms of Service

• The Company shall publish these Terms of Service on its Service or on a linked screen for the Users to access the information.
• The Company may amend these Terms of Service and shall announce the effective date and content of the amended Terms of Service and the reasons for the amendment seven (7) days prior to effective date of the amended Terms of Service. However, if any material rights or obligations of the Members are to be amended, the Company shall announce the amendment by the above method thirty (30) days prior to the effective date of the amended Terms of Service and notify the Members in accordance with the method set forth in Article 24(1). In this case, the Company must provide a copy of the then-current Terms of Service with the amended content in a manner that would allow the Users to compare the two contents easily.
• Users shall be deemed to have consented to the amended Terms of Service, if they do not explicitly express their rejection of the amended terms prior to the effective date of the amended Terms of Service, even after the Company announced or notified the Users of the amended Terms of Service stating that Users shall be deemed to have agreed to the amended Terms of Service if they do not express their rejection of the amended Terms of Service prior to its effective date. The Service may not be available to any User who does not consent to the amended Terms of Service, and the User may suspend their use of the Service and terminate their service agreement.
